Status as host of third-party content
In accordance with Article 6 of French Law no. 2004-575 of 21 June 2004 (LCEN) and Regulation (EU) 2022/2065 (Digital Services Act), the publisher acts as a host of content uploaded by users. It does not exercise prior control over such content and cannot be held liable for it unless it had actual knowledge of its manifestly unlawful nature and failed to act promptly to remove it.
User responsibility
Each user is solely and fully responsible for the content they publish and the acts they commit through the Service, including any breach of law: illegal content, harassment, violence, defamation, corruption, counterfeiting, hateful or discriminatory speech, invasion of privacy or image rights. The publisher cannot be held liable for its users' actions, and the user shall indemnify the publisher against any third-party claim resulting from their publications.
Reporting and removal of unlawful content (notice-and-takedown)
Any manifestly unlawful content may be reported via the built-in reporting tool or by email to abuse@cinelova.com. The report must specify the nature of the content, its location (URL) and the legal grounds. After review, the publisher promptly removes manifestly unlawful content and may retain related data for judicial requisition purposes. Abusive or bad-faith reports engage the liability of their author.
Limitation of the publisher's liability
The publisher cannot be held liable for indirect damages, data loss or temporary unavailability of the Service, nor for third-party links and services accessible from the platform. No limitation applies in the event of gross negligence or bodily injury, in accordance with the law.
