Reporting and appeal procedure (DSA)

In accordance with Regulation (EU) 2022/2065 on digital services (DSA) and the French LCEN, Cinelova provides a notice-and-action mechanism and an internal appeal procedure described below.
1. Reporting mechanism (notice-and-action)
Any user may report content they consider illegal via the "Report" button on each item, or by email to abuse@cinelova.com. For effective handling, a report should include: the exact location of the content (URL or identifier), a description of the facts, the reasons why the content is considered illegal, and the contact details of the reporter where relevant.
Reporting private messages
Any private message can be reported to moderation. Reported messages are placed in a dedicated moderation queue; a moderator may hide or remove the offending message and, where applicable, temporarily suspend its author's messaging. A moderation measure may be subject to the remedies provided in this procedure.
2. Handling of reports
Every report is acknowledged. It is examined promptly in a diligent, non-arbitrary and objective manner. Reports relating to content posing a serious risk (endangerment of minors, terrorism) are handled as a priority; other reports are handled within an indicative maximum period of 30 days, which may vary depending on volume. The reporter and, where applicable, the content author are informed of the decision and its reasons.
3. Statement of reasons
Where content is removed, made inaccessible, or an account is restricted, the user concerned receives a statement of reasons specifying the measure taken, the facts and circumstances, the legal or contractual basis (applicable law or the Terms/Charter), and the available means of redress.
4. Internal appeal and human review
Any moderation decision may be challenged within six months of its notification, by email to moderation@cinelova.com. The complaint is reviewed by a qualified person other than the one who made the initial decision; decisions are not taken solely on the basis of automated processing. The user is informed of the reasoned outcome of the review and retains the right to use an out-of-court dispute settlement body and to bring proceedings before the competent courts.
5. Measures against abuse and repeat offenders
In accordance with Article 23 of the DSA, users who repeatedly post manifestly illegal content, as well as persons who frequently submit manifestly unfounded notices or complaints, are subject, after warning, to temporary suspension and, if they persist, to permanent suspension of their account or of their ability to report.
Reporting venue reviews
Any review published on a venue page can be reported to moderation. Reported reviews are placed in the moderation queue; a moderator may hide or remove them and, where applicable, sanction their author. These measures may be subject to the remedies provided in this procedure.
6. Transparency
Cinelova periodically publishes a transparency report indicating in particular the number of reports received, content removed, accounts suspended, appeals handled, and average handling times. This report is accessible from the "Transparency" page. 6. Transparency.
