Terms and Conditions of Use

These Terms and Conditions of Use (the "Terms") govern access to and use of the Cinelova social network (the "Service"). By creating an account or using the Service, the user unreservedly accepts these Terms.
1. Purpose and service description
Cinelova is a public social network allowing users to create a profile, publish content (text, images, video), follow other members and interact. The Service offers free access as well as paid Premium and Platinum subscriptions described in the Terms of Sale.
2. Access and registration
- Registration is strictly limited to adults aged at least 18. The service is not available to minors.
- The user agrees to provide accurate information and to keep their credentials confidential. They are responsible for all activity carried out from their account.
- Creating fraudulent multiple accounts, impersonation and the use of false information are prohibited.
3. User-generated content
The user remains solely responsible for the content they publish. They warrant that they hold all necessary rights (copyright, image rights of depicted persons, related rights) and that their publications do not infringe any third-party right or legal provision.
By publishing content, the user grants the publisher a non-exclusive, free and worldwide license to host, reproduce and display that content solely for the operation and promotion of the Service, for the duration it remains online. The user retains ownership of their content.
The user shall not publish any unlawful content, including: child sexual abuse material, advocacy or incitement of terrorism, incitement to hatred or violence, insult and defamation, harassment, invasion of privacy, infringing content, discriminatory statements, or any content contrary to public order and morality.
4. Rules of conduct
It is forbidden to disrupt the operation of the Service, collect other users' data without consent, distribute malware, spam or any form of unauthorized solicitation.
Breach of these Terms or of the Community Guidelines may result in a warning, content removal, suspension or termination of the account, without prejudice to any legal action.
5. Intellectual property
The platform's trademarks, logos and elements are protected. Any unauthorized use is prohibited. User content remains their property, subject to the license granted above.
This warranty applies to all content and works published in any format, including images, photographs, written works and documents (e.g. PDF), audio, music and videos. The user warrants that they hold, or have obtained, all licences and authorisations necessary for the reproduction and public display of such works and of any third-party material they incorporate.
6. Liability
The Service is provided "as is". The publisher does not guarantee uninterrupted availability and cannot be held liable for content published by users, under the conditions set out in the disclaimer below. Disclaimer and limitation of liability.
7. Suspension and termination
The user may delete their account at any time. The publisher reserves the right to suspend or delete an account in case of breach of these Terms, while respecting the rights of defense.
9. Account security
The user is responsible for keeping their credentials secure and confidential. Any connection or action carried out through their account is presumed to be performed by them, until a compromise is notified to security@cinelova.com. The user undertakes to report any unauthorised use of their account without delay.
10. AI-generated or AI-assisted content
The user remains fully responsible for the content they publish, including where it has been generated or assisted by an artificial intelligence system. They warrant that such content complies with third-party rights and applicable law and undertake, where required by law, to disclose its artificial nature (deepfakes, synthetic content).
11. Automated data extraction
Without the prior written authorisation of the publisher, any automated data extraction (scraping), use of bots, crawlers or content harvesters, and any mass collection of user or platform data are prohibited. Such practices may result in immediate account suspension and legal action.
12. Warranty and indemnification
The user warrants and undertakes to indemnify the publisher against any claim, action, judgment, damages, and reasonable costs (including lawyers' fees) arising from a breach by the user of these Terms, of the law, or from content they have published.
13. Force majeure
The publisher shall not be liable for any non-performance or delay resulting from force majeure or events beyond its reasonable control, including: failure or interruption of telecommunications networks, failure of a hosting (OVH) or delivery (Cloudflare) provider, cyber-attack, strike, fire, natural disaster or decision of public authorities.
14. Liability cap
Save for any mandatory legal provision to the contrary, and without prejudice to cases of gross negligence or personal injury, the publisher's total liability, on any grounds whatsoever, shall not exceed the amounts actually paid by the user during the last twelve (12) months. For users of the free service, this cap is set at zero (0) euros.
Safety and user tools
The platform provides tools to control your interactions:
- Blocking: you can block a user. Your profiles, content and exchanges become mutually invisible and all messaging stops.
- Friends-only messaging: you can choose to be reachable only by your friends; others must send a contact request that you accept or decline.
- Reporting: you can report content or a message to moderation.
Moderation and sanctions
Our moderators may review reported content and messages, hide or remove a message that breaches the rules and, in case of abuse, temporarily suspend the messaging access of the user concerned. These measures aim to protect the community and are applied proportionately, without prejudice to the remedies provided in our reporting procedure (DSA).
8. Governing law and disputes
These Terms are governed by French law. In the event of a dispute, and after attempting an amicable resolution, the French courts have jurisdiction. Consumers may use a consumer mediator or the European online dispute resolution platform (ec.europa.eu/consumers/odr).
Users who are consumers retain the benefit of the mandatory protective provisions of the law of their country of residence within the European Union; no provision herein may deprive them of these.
